Am I entitled to sick leave as a casual worker in Australia?

Sick Leave for Casual Workers in Australia
Yes, casual workers are entitled to paid sick leave, but the rules are different from permanent employees.
Your Entitlements
From 1 July 2024, casual workers are entitled to:
- Paid personal/carer's leave – you earn 1 week (38 hours) per year of employment
- Paid compassionate leave – 2 days when a family member dies or has a serious illness
- Paid jury duty leave – if called to jury service
How It Works
Casual sick leave is calculated based on hours worked. You accrue it gradually throughout the year. Your employer must pay you at your ordinary rate of pay when you take it.
You should notify your employer as soon as possible when you need to take sick leave, usually following their standard procedures.
Important Points
- Sick leave can be used for your own illness or to care for a family member
- You don't lose accrued leave if you change jobs – it's yours to keep
- Your employer cannot refuse reasonable requests for sick leave
- You may need to provide a medical certificate if absent for 3+ consecutive days
If There's a Problem
If your employer refuses to pay sick leave or treats you unfairly, contact the Fair Work Ombudsman for free advice and support.
