Casual Employee Entitlements in Australia

Casual employees have fewer guaranteed entitlements than permanent staff, but are still protected by Australian workplace laws. Here's what you're entitled to:

Pay and Hours

  • Casual loading: You must receive at least 25% extra pay on top of the ordinary hourly rate to compensate for lack of job security and benefits
  • Minimum wage: You're entitled to at least the National Minimum Wage or your award rate
  • Paid breaks: Rest breaks are provided (unpaid meal breaks, paid short breaks)

Leave Entitlements

  • No paid annual leave: Casual loading replaces this
  • No paid sick leave: However, you can't be dismissed for taking unpaid leave due to illness
  • No paid long service leave: This applies to permanent employees only
  • Unpaid parental leave: You may be entitled to unpaid leave for caring responsibilities

Other Protections

  • Superannuation: Your employer must contribute 11.5% (2024 rate) to your super if you earn $350+ per week
  • Unfair dismissal: You can claim unfair dismissal if you've worked for 12 months (6 months for small businesses)
  • Discrimination protection: Protected from discrimination based on age, gender, disability, race, religion, and other grounds
  • Safety: Right to a safe workplace and to refuse unsafe work
  • Payslips: You must receive itemised payslips within one week of payment

Important Notes

Casual loading is not a bonus—it's part of your ordinary pay and must be included in every payment. You cannot be asked to "sacrifice" it.
