Subclass 820 (Temporary Partner Visa)

  • Status: Temporary visa
  • Duration: Granted for 2 years initially
  • Work rights: Full-time work permitted
  • Study rights: Can study
  • Purpose: Allows you to live in Australia while your permanent partner visa application is being assessed
  • Processing: You apply for both 820 and 801 together

Subclass 801 (Permanent Partner Visa)

  • Status: Permanent visa
  • Duration: Indefinite (no expiry date)
  • Work rights: Full-time work permitted
  • Study rights: Can study
  • Purpose: Grants permanent residency after your relationship has been assessed
  • Processing: Granted after 820, usually after 2 years if relationship requirements are met

The Process

You typically apply for both visas at the same time. You receive the 820 first, which lets you stay and work in Australia temporarily. After 2 years (or sometimes longer), if your relationship is still genuine and ongoing, the Department of Home Affairs grants you the 801 permanent visa.
